Debt Defense and Collection
We understand debt and how oppressive creditor tactics can wreak havoc on your business or personal life. When faced with debt issues, many people will stick their head in the sand – hoping that the problem will go away. It won’t.
When we represent a business or individual who is being threatened with a demand, or has already been sued, we first undertake a careful analysis of the claim to make sure the debt or claim is valid under Texas law. We next identify any leverage points that can be used in negotiating a resolution. For example, did the creditor comply with all applicable preconditions to asserting the claim, such as any required notices under the contract or statute? Did the creditor comply with the Fair Debt Collection Practices Act ? Did the creditor make any false or misleading representation while attempting to collect the debt? The answers to these legal questions may provide potential leverage points in negotiating a settlement of your debt. These types of proceedings require experienced representation as they often present complex legal issues.
We are often hired to represent businesses and individuals when faced with a frozen bank account or property due to a Writ of Garnishment, liens, levies, or other collection action. We are experienced at identifying available defenses to these extraordinary actions, developing a strategy to maximize leverage, and negotiating a resolution. If a settlement is not feasible, we harness over 26 years of trial experience to fight for your rights under the law.
Many in this position think bankruptcy is the only option. In our experience, many debt issues can be resolved without the need for an expensive bankruptcy proceeding and the adverse impact on your credit. However, if bankruptcy is a remedy you need to consider, we work with some of the best bankruptcy attorneys in North Texas and will make sure you are connected with these resources.
Our clients have also had success in recovering debts from creditors and enforcing security interests.
