Claims under the Texas Residential Construction Liability Act (RCLA)
Claims against builders and contractors can be complex. Under the RCLA, economic damages can be limited to certain types of damages, and all losses may not be recoverable. For instance, moving costs, mental anguish and loss of use are generally not recoverable under the RCLA. Likewise, the costs of engineering consultants can be recovered, but the procedure for recovery of these expenses can be complex.
